Terms of Service
Version 1. These terms cover the storefront audits, fixes and theme builds described on altamiracommerce.com. A signed or emailed statement of work for a specific engagement prevails over these terms where the two differ.
1. Who you are contracting with
Altamira Commerce is the trading name of Victor Campos, an independent contractor based in Puebla, Mexico. It is not a company: the party you contract with is Victor Campos, an individual, at Cipreses #22, Fracc. Cipreses de Mayorazgo, 72480 Puebla, Puebla, México.
In these terms, "we" and "us" mean Victor Campos trading as Altamira Commerce; "you" means the business engaging us.
2. What we do
- Storefront audit. A written document: what is broken on your storefront, the exact URL, what it takes to fix, ordered by impact over effort. It is yours to keep and to hand to any developer you like.
- Fixes and builds. Theme work, checkout paths, product page structure, and migrations between Shopify and WooCommerce, scoped line by line from an audit or from a written brief.
- Theme builds. Complete Shopify themes built from the ground up, scoped and quoted individually.
Anything not written into the agreed scope is not included. Additional work is scoped and priced separately, in writing, before it starts.
3. Prices, currency and payment
- Storefront audit: free, for the first ten stores, because we are building a published series of audits.
- Fixes: from $1,500.
- Builds and migrations: from $4,000.
All prices are in United States dollars (USD). The figures above are starting prices, and what an engagement costs above them depends on its scope. The fixed price for your engagement is agreed in writing before work starts, and it does not change unless you ask for work outside the agreed scope and we agree the change in writing.
Payment schedule: half of the agreed price to start, the other half on delivery.
Paying from Mexico. A payment obligation in United States dollars that is to be settled in Mexico may be discharged in Mexican pesos, at the exchange rate published by the Banco de México for the payment date, as provided by article 8 of the Ley Monetaria de los Estados Unidos Mexicanos.
Tax. Prices are quoted before any tax that may apply. We make no statement here about whether value added tax (IVA) applies to a given engagement; that is settled in the written agreement before work starts.
4. What you receive, and what you own
The audit is delivered as a document. You keep it, you may share it inside your business, and you may hand it to any developer.
Fixes, builds and themes are delivered into your own store account and your own theme files. On payment in full for the engagement, the code and assets we write for you are yours. We host nothing for you, we hold no part of your store hostage, and there is no retainer required to keep what we built working.
We keep the right to reuse the general knowledge, methods and non-specific techniques we bring to the work or develop during it. That right does not extend to your content, your data, or anything specific to your store.
5. No guarantee of business results
We deliver the work described in the agreed scope. We do not promise, guarantee or predict any business outcome. Sales, traffic, conversion, search rankings, ad performance and revenue depend on your products, your pricing, your market, your advertising, platform behaviour, and many other factors outside our control. We make no representation about results, and nothing on our site or in our correspondence should be read as one.
Findings in an audit describe what we observed on your live storefront at the time we looked. They are not a promise about what fixing them will produce.
6. Access to your store
Where the work needs it, you grant us collaborator or staff access to your store and, where relevant, to your theme repository. Grant the narrowest access that lets the work happen, and grant it as a revocable invitation rather than by sharing a password. We use that access only for the agreed work, and you may revoke it at any time. Revoking it before the work is finished may stop us from finishing it.
You confirm that you are entitled to grant that access and that the content on your store is yours to use.
7. Third-party platforms
Your store runs on a platform we do not control. Your agreement with Shopify or with WooCommerce and your host, and their terms, fees, uptime and changes, are between you and them. We are not affiliated with Shopify or with Automattic and WooCommerce, and neither company endorses us or our work. Platform or app fees, theme licences and hosting are yours to pay and are never included in our prices.
8. Cancellation
Audit. You may cancel before the document is delivered. An audit cancelled before delivery is refunded in full.
Fixes, builds and theme builds. A build in progress is charged for the work already completed, and the written scope for the engagement sets out what is delivered on cancellation.
We may decline or end an engagement if the work turns out to be materially different from what was scoped, or if we are asked to do something we consider deceptive or unlawful. If we end an engagement for our own reasons, you pay only for work already delivered.
9. Confidentiality
What is wrong with your storefront stays between you and us. We name no store publicly except with written permission, publish no findings about it, and use it in no marketing.
The one published audit is the exception already on the site: it was unsolicited and unpaid, was written entirely from publicly visible pages with no analytics or admin access, the store it covers is not named, and it is public. It sets no precedent for what we would publish about an engagement.
We treat what you send us as confidential and handle personal data as described in the Privacy Policy and, for Mexico, the Aviso de Privacidad (Mexico).
10. Liability
Our total liability arising out of or in connection with an engagement is limited to the fees you have paid for that engagement. We are not liable for lost profits, lost sales, lost data or indirect or consequential loss.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud, and nothing here removes a right that consumer law gives you and that cannot be waived by agreement.
11. Governing law and where disputes go
These terms, and any engagement under them, are governed by Mexican law, and the courts of Puebla, Mexico have jurisdiction. Under the Ley Federal de Protección al Consumidor, a business that buys services in order to integrate them into its own commercial activity is treated as a consumidor only for the queja under article 99 and the arbitration under article 117 of that law, and a company only where it is accredited as a microempresa or microindustria. Where those conditions are met, nothing in these terms removes your ability to bring a queja before the Procuraduría Federal del Consumidor (PROFECO).
We would rather settle a disagreement by email first. Write to us and say what is wrong.
12. Changes to these terms
Changes to these terms are published on this page, at this same address. The terms that apply to your engagement are the ones in force when the scope was agreed in writing.
